1. About these terms

These Terms of Service govern your access to and use of bjnicolsfurniture.com, operated by BJ Nicols Furniture Empire,

. By browsing the site or placing an order you agree to these terms. If you do not agree with them, please do not use the site.

Our Shipping Policy, Refund and Return Policy, Payment Policy and Privacy Policy form part of these terms.

2. Who may use the site

You must be at least 18 years old and able to enter into a binding contract to place an order. By ordering you confirm that you meet those conditions and that the information you give us is accurate and complete.

3. Your account

You can order as a guest or create an account. If you create one, you are responsible for keeping your password confidential and for activity that happens under your login. Tell us at support@bjnicolsfurniture.com if you believe someone else has used your account. We may suspend or close an account that is being used fraudulently or to abuse the site.

4. Products, descriptions and images

We describe our products as accurately as we can, including dimensions, materials and finishes. Photographs are taken under studio lighting and colours can appear differently on different screens. Natural materials such as wood, rattan, marble and boucle vary in grain, tone and pattern from piece to piece, and that variation is a normal characteristic of the material rather than a fault.

5. Pricing and availability

Prices are shown in United States dollars and can change at any time before you place an order. The price that applies to your order is the price displayed at the moment you complete checkout.

Stock levels shown on the site are kept up to date, but an item can occasionally sell out between your adding it to the cart and completing checkout. If an item you ordered is unavailable, we contact you and refund that item in full.

Despite our care, a listing can contain an error in price, description or availability. Where an obvious error is discovered after you order, we may cancel the order and refund you in full. We will always contact you before doing so, and you may confirm the corrected price instead if you prefer.

6. Orders and acceptance

Submitting an order is an offer to buy. The confirmation email we send immediately afterwards acknowledges that we received it; it is not yet acceptance. The contract of sale is formed when we confirm that your order has been accepted for shipping.

We may decline or cancel an order where the item is unavailable, where a pricing or listing error applies, where payment cannot be verified, where the delivery address is outside the area we serve, or where we reasonably suspect fraud. If we cancel an order you have paid for, we refund it in full.

7. Delivery and risk

Delivery timescales, costs and procedures are set out in our Shipping Policy. Delivery estimates are estimates and not guaranteed dates. Risk of loss and damage passes to you when the order is delivered to the address on the order. Ownership passes to you when we have received payment in full.

8. Returns and cancellation

Your right to return an item, the condition it must be in, and how refunds are handled are set out in our Refund and Return Policy. Nothing in these terms limits rights you have under applicable consumer protection law.

9. Assembly and safe use

Where a product requires assembly, follow the instructions supplied with it and use all the fixings provided. Furniture should be placed on a level surface and used only for its intended purpose. Tall or heavy items should be secured to a wall where the instructions say so. We are not responsible for damage or injury that results from incorrect assembly, modification, or use that the product was not designed for.

10. Reviews and submitted content

If you post a review or other content on the site, you confirm that it is your own, that it is truthful, and that it does not infringe anyone else’s rights. You give us permission to display, edit for length and clarity, and remove that content. We may remove content that is unlawful, abusive, misleading or unrelated to the product.

11. Intellectual property

The site design, text, graphics, logos and photographs are owned by BJ Nicols Furniture Empire or used under licence, and are protected by copyright and trade mark law. You may view and print pages for your own personal, non commercial use. You may not copy, republish, scrape or use our content for any commercial purpose without our written permission.

12. Acceptable use

You agree not to use the site to break the law, to place fraudulent orders, to interfere with the site’s operation or security, to collect data by automated means without our permission, or to introduce malicious code.

13. Third party links

The site links to services we do not control, including social and review platforms and mapping services. Those links are provided for convenience. We are not responsible for the content, policies or availability of a third party site.

14. Disclaimers

The site is provided on an as is and as available basis. We do not warrant that the site will be uninterrupted, error free, or free of harmful components, and we do not warrant that the information on it is complete or current at all times. This does not affect any statutory rights or any manufacturer warranty that comes with a product.

15. Limitation of liability

To the extent permitted by law, BJ Nicols Furniture Empire is not liable for indirect, incidental, special or consequential losses arising from your use of the site or from a product, including lost profits or loss of data. Where liability cannot be excluded, our total liability in connection with an order is limited to the amount you paid for that order. Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

16. Indemnity

You agree to indemnify BJ Nicols Furniture Empire against claims, losses and reasonable costs arising from your breach of these terms or your misuse of the site.

17. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute that cannot be resolved between us will be brought in the state or federal courts located in Queens County, New York, and you and we consent to the jurisdiction of those courts.

18. Changes to these terms

We may update these terms. The date at the top of this page shows when they were last revised. Changes take effect when they are posted. The terms that apply to an order are those in force when the order was placed.

19. General

If a provision of these terms is found to be unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the policies referenced in section 1, are the entire agreement between you and us in relation to your use of this site.
